00:00:00 --> 00:00:02 Hey, hey everybody. This is Demia Avery

00:00:02 --> 00:00:05 of the Demia Avery Show. So, this is the

00:00:05 --> 00:00:07 second half of my video. This is the

00:00:07 --> 00:00:10 defense opening statement for the Diddy

00:00:10 --> 00:00:14 trial day one, and I'm just going to go

00:00:14 --> 00:00:15 over it. If you haven't seen the first

00:00:15 --> 00:00:17 one, make sure you go back and check

00:00:17 --> 00:00:20 that one out. So, here we go. The

00:00:20 --> 00:00:23 attorney's name for Diddy's last name is

00:00:23 --> 00:00:26 Garagos. All right. So Garrett Ghost

00:00:26 --> 00:00:29 begins saying, "Uh, Sean Combmes is a

00:00:29 --> 00:00:31 complicated man, but this is not a

00:00:31 --> 00:00:34 complicated case. The case is about

00:00:34 --> 00:00:37 love, jealousy, infidelity, and money.

00:00:37 --> 00:00:39 This case is about voluntary adult

00:00:39 --> 00:00:42 choices made by capable adults and

00:00:42 --> 00:00:43 consensual

00:00:43 --> 00:00:45 relationships. At a time when everything

00:00:45 --> 00:00:48 in government can feel so uncertain, one

00:00:48 --> 00:00:50 thing remains the same. The one thing

00:00:50 --> 00:00:52 standing between all of us and criminal

00:00:52 --> 00:00:56 conviction is a jury of our peers. There

00:00:56 --> 00:00:58 has been a tremendous amount of noise

00:00:58 --> 00:01:00 around the case over the last year. It

00:01:00 --> 00:01:02 is a time to cancel the noise and hear

00:01:02 --> 00:01:04 and see the evidence presented in this

00:01:04 --> 00:01:07 courtroom and it will be crystal clear.

00:01:07 --> 00:01:09 You will see them put on a performance

00:01:09 --> 00:01:11 high on ecstasy while they pretend to

00:01:11 --> 00:01:14 enjoy themselves because that's what the

00:01:14 --> 00:01:17 defendant said she wanted.

00:01:17 --> 00:01:19 uh standing in this courtroom at 55

00:01:19 --> 00:01:21 years old in the same place he was born

00:01:21 --> 00:01:23 and raised. He's going by the same name

00:01:23 --> 00:01:27 he was born with. Shawn Combmes Gargo

00:01:27 --> 00:01:29 says this is about private personal

00:01:29 --> 00:01:31 smeck's life which has nothing to do

00:01:31 --> 00:01:35 with his lawful businesses. The people

00:01:35 --> 00:01:37 who will take the stand will say that

00:01:37 --> 00:01:40 they knew nothing about any enterprise.

00:01:40 --> 00:01:42 That's because these hardworking

00:01:42 --> 00:01:45 individuals were doing their jobs,

00:01:45 --> 00:01:48 running his businesses. She goes on to

00:01:48 --> 00:01:50 say that Diddy takes full responsibility

00:01:50 --> 00:01:53 for acts of domestic violence in this

00:01:53 --> 00:01:58 case, but domestic violence is not smeck

00:01:58 --> 00:02:01 trafficking. Domestic violence is a very

00:02:01 --> 00:02:04 serious matter. It is bad and an illegal

00:02:04 --> 00:02:07 problem. We take full responsibility

00:02:07 --> 00:02:09 that there was domestic violence in this

00:02:09 --> 00:02:13 case. Domestic violence is not smeck

00:02:13 --> 00:02:15 trafficking. I want to say it again.

00:02:15 --> 00:02:17 Domestic violence is not smeck

00:02:17 --> 00:02:19 trafficking. Had he been charged with

00:02:20 --> 00:02:22 domestic violence or assault, we would

00:02:22 --> 00:02:26 not be here right now. Shawn Combmes has

00:02:26 --> 00:02:28 a temper and when he drank and took the

00:02:28 --> 00:02:31 wrong drugs, he got violent. My client

00:02:31 --> 00:02:34 is not proud of that. John Combmes has a

00:02:34 --> 00:02:36 bad temper and sometimes when he gets so

00:02:36 --> 00:02:39 angry or jealous, he sometimes gets out

00:02:39 --> 00:02:42 of control. Um, Gyros went on to say

00:02:42 --> 00:02:44 that there may be points in the trial

00:02:44 --> 00:02:46 where jurors think that Combmes is a

00:02:46 --> 00:02:49 jerk or he's mean. He's not charged with

00:02:50 --> 00:02:52 being a jerk or being mean. He's charged

00:02:52 --> 00:02:54 with running a criminal enterprise, she

00:02:54 --> 00:02:57 said. In her opening statement, defense

00:02:57 --> 00:03:01 uh attorney Geros referenced the massive

00:03:01 --> 00:03:03 amount of baby oil that was seized by

00:03:04 --> 00:03:07 law enforcement searching Diddy's home

00:03:07 --> 00:03:10 last year. She says, "You may know of

00:03:10 --> 00:03:12 his love of baby oil. Is that a federal

00:03:12 --> 00:03:16 crime?" No.

00:03:16 --> 00:03:20 Prosecutors. Uh oh, guys, I lost my Oh.

00:03:20 --> 00:03:22 Prosecutors alleged Combmes used baby

00:03:22 --> 00:03:24 oil during what he called freakoffs or

00:03:24 --> 00:03:27 elaborate SMMEX performances in which he

00:03:27 --> 00:03:30 allegedly drugged and coerced victims

00:03:30 --> 00:03:33 into extending SMMEX acts with male

00:03:33 --> 00:03:37 SMMEX workers. in court today. Uh Geros

00:03:38 --> 00:03:40 says Combmes would be accountable for

00:03:40 --> 00:03:42 these things he did, but we will fight

00:03:42 --> 00:03:45 for his freedom for the things he did

00:03:45 --> 00:03:48 not do. She says Garagos tells the jury

00:03:48 --> 00:03:51 that they will hear evidence of Comb's

00:03:51 --> 00:03:54 smeual preferences and it may make them

00:03:54 --> 00:03:56 uncomfortable. She says the events in

00:03:56 --> 00:03:58 the hotel rooms were part of a swinger's

00:03:58 --> 00:04:01 lifestyle, which she describes as a

00:04:01 --> 00:04:05 fancier term for a threesome, but you

00:04:05 --> 00:04:07 are not here to judge him for his sexual

00:04:07 --> 00:04:10 preferences, she tells the jury. Uh the

00:04:10 --> 00:04:12 attorney goes on to uh say she brought

00:04:12 --> 00:04:15 up the 2016 hotel surve surveillance

00:04:15 --> 00:04:18 video in which Diddy is seen physically

00:04:18 --> 00:04:21 assaulting his then girlfriend Cassie

00:04:21 --> 00:04:24 that day. Unfortunately, jealousy was on

00:04:24 --> 00:04:26 full display, Geralgo said, adding that

00:04:26 --> 00:04:29 Combmes had taken bad drugs. What

00:04:29 --> 00:04:31 Combmes did to Cassie on this videotape

00:04:31 --> 00:04:34 is indefensible. It's horrible. It's

00:04:34 --> 00:04:36 dehumanizing. It's violent. It's

00:04:36 --> 00:04:38 virtually every bad word you can think

00:04:38 --> 00:04:41 of. It is not evidence of sex

00:04:41 --> 00:04:44 trafficking, she said. It is evidence of

00:04:44 --> 00:04:47 domestic violence. I'm not justifying

00:04:47 --> 00:04:49 the assault, not by a long shot, but I

00:04:49 --> 00:04:52 am putting it putting it in the proper

00:04:52 --> 00:04:55 context, she said. In 2018, Cassie

00:04:55 --> 00:04:58 Ventur saw a gossip site posting about

00:04:58 --> 00:05:00 Diddy walking out of a hotel room with

00:05:00 --> 00:05:03 another woman and decided to end things.

00:05:03 --> 00:05:06 His attorney said she made a choice

00:05:06 --> 00:05:08 every single day for years. a choice to

00:05:08 --> 00:05:11 stay with him, a choice to fight for him

00:05:11 --> 00:05:14 because for excuse me 11 years that was

00:05:14 --> 00:05:16 the better choice. That was her

00:05:16 --> 00:05:18 preferred choice. She made the choice to

00:05:18 --> 00:05:20 stay with him until one day she decided

00:05:20 --> 00:05:22 she was going to break up with him

00:05:22 --> 00:05:25 because that was her preferred choice.

00:05:25 --> 00:05:27 When she made that decision to leave,

00:05:27 --> 00:05:28 there was no repercussions as the

00:05:28 --> 00:05:30 government hinted. She made the choice

00:05:30 --> 00:05:33 to leave. She communicated it to him and

00:05:33 --> 00:05:36 ran into the arms of another man.

00:05:36 --> 00:05:38 physical trainer Comolmes had hired to

00:05:38 --> 00:05:39 train

00:05:39 --> 00:05:43 her. She goes on to say, "Ventur left

00:05:43 --> 00:05:46 the relationship on her terms. The end

00:05:46 --> 00:05:48 of the relationship between Cassie and

00:05:48 --> 00:05:51 Combmes is important. She left on her

00:05:51 --> 00:05:53 terms her choices and for the reasons

00:05:53 --> 00:05:56 that for her were the right reasons."

00:05:56 --> 00:05:59 Geros said that Ventur was a willing

00:05:59 --> 00:06:01 participant in their Smeck's life. This

00:06:01 --> 00:06:04 was a voluntary adult choice by two

00:06:04 --> 00:06:05 capable

00:06:05 --> 00:06:08 adults. Um, the defense attorney said

00:06:08 --> 00:06:11 the videos of the freakoffs are intimate

00:06:11 --> 00:06:13 and jurors may find them hard to watch,

00:06:13 --> 00:06:16 but argued they are strong evidence that

00:06:16 --> 00:06:19 the events were consensual and not based

00:06:19 --> 00:06:20 on

00:06:20 --> 00:06:23 coercion. Gergos said that Jane

00:06:23 --> 00:06:26 willingly participated in hotel nights

00:06:26 --> 00:06:29 with Diddy Combmes for three years. She

00:06:29 --> 00:06:31 tried many times to change the tenure of

00:06:31 --> 00:06:33 their relationship to something deeper

00:06:34 --> 00:06:36 or more meaning meaningful, but it

00:06:36 --> 00:06:38 always came back to what they would call

00:06:38 --> 00:06:41 parties these nights in the hotel rooms.

00:06:41 --> 00:06:44 Um Col's attorney went on to say that

00:06:44 --> 00:06:46 Jane was driven by jealousy. If she

00:06:46 --> 00:06:48 walked away, she would have lost him,

00:06:48 --> 00:06:50 and that is not something she was

00:06:50 --> 00:06:53 willing to do. Garagos described Jane

00:06:53 --> 00:06:56 and Col's relationship as toxic and

00:06:56 --> 00:06:58 dysfunctional. She said Jane traveled to

00:06:58 --> 00:07:01 see Holmes many times and continued to

00:07:01 --> 00:07:04 engage in the freakoffs even after the

00:07:04 --> 00:07:05 phone call in

00:07:05 --> 00:07:08 2023. "Being a willing participant in

00:07:08 --> 00:07:11 your own smeck's life is not Smeck's

00:07:11 --> 00:07:14 trafficking," she said. The uh Garagos

00:07:14 --> 00:07:16 ended her opening statements by urging

00:07:16 --> 00:07:18 jurors to consider motive as they hear

00:07:18 --> 00:07:21 testimony during the trial. Diddy

00:07:21 --> 00:07:23 Combmes. She referenced one of Comb's

00:07:23 --> 00:07:26 employees who prosecutors earlier said

00:07:26 --> 00:07:29 Combmes smeually abused. She encouraged

00:07:29 --> 00:07:32 the jury to look closely at the realtime

00:07:32 --> 00:07:35 communications. Everybody who testifies

00:07:35 --> 00:07:38 has a motive. Garagos also questioned

00:07:38 --> 00:07:40 why none of Comb's employees reported

00:07:40 --> 00:07:43 the workplace allegations that that have

00:07:43 --> 00:07:46 come up in this case until now. For many

00:07:46 --> 00:07:48 of them, the answer is simple. Money,

00:07:48 --> 00:07:52 she said. All right, guys. So that's it

00:07:52 --> 00:07:55 for uh right now. Those are the opening

00:07:55 --> 00:07:57 statements. Talk to you guys later.

00:07:57 --> 00:08:00 Bye-bye.
